Search Montgomery County Criminal Records
Montgomery County criminal records are kept by the Sheriff's Office and Circuit Court in east-central Missouri, with the Sheriff's Office providing an online inmate and warrant search system that makes it easier to check current detentions and active warrants without visiting a courthouse. This page explains your full range of options for finding arrest records, court history, and criminal background data tied to Montgomery County.
Montgomery County Criminal Records Quick Facts
Montgomery County Sheriff's Office
The Montgomery County Sheriff's Office handles law enforcement and jail operations for the county. What sets it apart from many rural Missouri counties is that it maintains an online inmate and warrant search system, giving the public a faster way to check current jail bookings and active warrants without calling or visiting in person.
To reach the Sheriff's Office or find the link to its online search, visit montgomerycountymo.gov. The county government website lists contact information for all county departments including the Sheriff.
For records of past arrests rather than current detainees, you will need to submit a written Sunshine Law request or use the statewide MACHS system. The online inmate system covers who is currently held, not historical booking data going back years. Keep that distinction in mind when deciding which tool to use for your search.
Under Missouri's Sunshine Law, the Sheriff's Office must respond to written records requests within three business days. Address requests to the records custodian and be specific about what you need.
Court Records Through Case.net
For court case history, Missouri Case.net is the best free resource available. The system covers all 114 Missouri counties, including Montgomery, and requires no account or fee. Search by name, case number, or filing date to find criminal charges, court events, motions, and case outcomes.
Case.net shows whether a case ended in conviction, dismissal, or acquittal and whether it is still active. The system does not display document images. To get actual copies of court filings, contact the Montgomery County Circuit Clerk in Montgomery City. Fees apply for copies, with certified copies costing more than standard ones. It is worth calling ahead to confirm current rates.
Note: Closed records do not appear in Case.net. Missouri law closes arrest records that lead to no charges within 30 days, and closes case records when charges are dismissed, nolle prossed, or the defendant is found not guilty.
Statewide Criminal History Through MACHS
The Missouri Automated Criminal History Site at machs.mo.gov lets you run a statewide criminal background check on anyone in Missouri. Name-based searches cost $15 and return what the system calls a "possible match." That term reflects the fact that results are tied to the name entered rather than a confirmed fingerprint identity, so some care in reading the results is needed.
A name-based MACHS search pulls convictions from across the state, arrests less than 30 days old, charges with pending dispositions, and suspended impositions of sentence active during probation. The data comes from the Missouri State Highway Patrol's Criminal Justice Information Services Division in Jefferson City. The CJIS office can be reached at (573) 526-6153.
Fingerprint-based searches cost $20 for state-only results and $33.25 with an FBI check included. These searches return both open and closed records and are considered positive identity matches. IDEMIA handles fingerprint capture appointments at a separate fee. Notarized results cost $5 extra. For most general inquiries, the $15 name search is the right starting point.
Missouri Sunshine Law and Public Record Rights
Missouri's Chapter 610 Sunshine Law is what gives the public the right to access criminal records held by government agencies in Montgomery County and across the state. Arrest records are public by default once an investigation is closed. Government agencies must respond to written requests within three business days.
Two exceptions close records to public view. Section 610.105 closes an arrest record if no charges are filed within 30 days of the arrest. Records also close when charges are filed but are later dismissed, nolle prossed, or the defendant is found not guilty. Those closed records will not appear in public searches. They may still be accessible through authorized fingerprint-based MACHS checks.
When filing a Sunshine Law request with Montgomery County agencies, write it out clearly. Address it to the office holding the records, include the subject's name and relevant time frame, and state what you are looking for. Keep a copy of your request and any response you receive.
Sex Offender Registry
The Missouri Sex Offender Registry is free to search at mshp.dps.missouri.gov. The Missouri State Highway Patrol runs it. You can search by name, date of birth, or address. The registry lists compliant and non-compliant registrants, with photos, current addresses, and offense details.
For Montgomery County specifically, use the address-based search to find registered sex offenders in Montgomery City or other parts of the county. The toll-free line is 1-888-SOR-MSHP (1-888-767-6747). The registry is updated as law enforcement agencies report new or changed information.
Department of Corrections Offender Search
The Missouri Department of Corrections offender search is a free online tool that covers people currently on probation or parole in Missouri. Enter a first and last name to search. Discharged offenders are not included in the database. This tool complements rather than replaces Case.net and MACHS.
For details not available online, contact the Parole Board at (573) 751-8488 or email probation.parole@doc.mo.gov. The main DOC office is at 2729 Plaza Drive, Jefferson City, MO 65102. The DOC search is most useful when you already know someone is under active supervision and want to verify the fact.
Note: Using the DOC search alongside Case.net gives you both court disposition history and current supervision status, which together tell a fuller story than either source alone.
Expungement in Montgomery County
Under RSMo 610.140, Missouri residents can petition to have criminal records expunged. Misdemeanor convictions require a three-year waiting period from final disposition. Felony convictions require seven years. The lifetime cap is one felony and two misdemeanors.
To qualify, you must have no pending charges, must have paid all fines and restitution, and must have no new convictions other than minor traffic violations. The petition goes to the court that handled the original case. For Montgomery County cases, that is the Montgomery County Circuit Court. If approved, all state agencies must destroy the records. Denial means a one-year wait before you can refile.
Local legal aid services or an attorney familiar with Missouri expungement law can help you assess eligibility and avoid errors in the petition. Getting it right the first time saves considerable time and effort.
