Douglas County Sheriff's Office

The Douglas County Sheriff's Office is located at 209 SE 2nd Ave, Ava, MO 65608. The main phone number is (417) 683-1020. The Sheriff's Office provides law enforcement services for the county and operates the county jail. Arrest records, incident reports, inmate information, and warrant data are all maintained by this office.

For records requests, contact the Sheriff's Office during normal business hours. In-person visits are the most common approach for obtaining arrest records and jail information. Bring a photo ID. If the office accepts mailed or faxed requests, call ahead to ask about the process and any applicable fees. Recent bookings at the county jail can typically be confirmed by calling the office directly.

Under Missouri's Sunshine Law (Chapter 610), arrest and incident reports are public records once a case is closed. Section 610.105 specifies that arrests not resulting in charges within 30 days become closed. Cases dismissed or ending in acquittal also result in closed records. Convictions and active cases are generally open to the public.

Note: arrests made within Ava city limits by the Ava Police Department result in records held at the police department, not the Sheriff's Office. For city arrests, contact the Ava Police directly.

Statewide Background Checks Through MACHS

The Missouri Automated Criminal History Site (MACHS) is the main tool for statewide criminal background checks. A name-based search costs $15. No consent from the subject is needed. Results are a "possible match" from open public records: convictions, arrests less than 30 days old, charges awaiting disposition, and suspended imposition of sentence records during probation. Payment is by credit card online.

Fingerprint-based searches are more thorough. They cost $20 for state-only results or about $41.75 with the federal FBI check. Fingerprint searches include closed records and some expunged data. You schedule fingerprinting through IDEMIA. State checks take 7 to 10 business days. Out-of-state checks take 4 to 6 weeks. A notarized result costs an extra $5.

The Missouri State Highway Patrol CJIS Division manages MACHS and maintains the statewide criminal history repository. They are located at 1510 East Elm Street, Jefferson City, MO 65101. Phone: (573) 526-6153.

Missouri Sunshine Law and Douglas County Records

Missouri's Sunshine Law, codified in Chapter 610 of the Revised Statutes, establishes that government records are public by default. Criminal records fall under this law. Section 610.023 requires agencies to respond to records requests within three business days. Responses can provide the records, deny with a specific legal reason, or explain when records will be ready.

In Douglas County, records requests for arrests and jail information go to the Sheriff's Office. Requests for court records go to the Circuit Clerk. For a records request to work efficiently, be as specific as possible. Include the full name of the person, approximate dates, and what type of record you need.

Sealed records, juvenile cases, and records containing sensitive personal information can be withheld. If you believe a denial was improper, the Missouri Attorney General's office handles Sunshine Law complaints. Challenges can also be filed in circuit court.

Expungement of Douglas County Criminal Records

Missouri's expungement law is RSMo Section 610.140. Eligible individuals can petition the circuit court to have criminal records destroyed. The waiting period is three years for misdemeanors and seven years for felonies, measured from the date the case ended. You must have no other convictions beyond minor traffic violations, no pending charges, and all fines and restitution paid.

Missouri limits lifetime expungements to one felony and two misdemeanors per person. For Douglas County cases, the petition is filed at the Douglas County Circuit Court in Ava. If the court approves, all state agencies must destroy their records. If denied, wait one year before refiling.

The MSHP CJIS Division at (573) 526-6153 can tell you what records currently exist and how an approved expungement would affect them. Consult an attorney to assess whether your case qualifies and how to build the petition.
